1. Agreement and eligibility

Fareld is operated by Randy Fust, 27 Capehart Dr., Orlando, FL 32807, USA. By creating an account or using Fareld, you agree to these Terms. You must be at least 13 years old and legally able to agree to them. If local law requires a higher minimum age, that higher age applies. If you are under the age of legal majority, a parent or guardian must approve your use.

2. What Fareld provides

Fareld offers a shared daily photo challenge, private journals, achievements, community submissions, optional ratings, reports, and blocking tools. Features may change, pause, or end. Fareld does not promise that every challenge is suitable for every person, place, weather condition, or ability.

3. Account responsibilities

Provide accurate information, protect your password and device, and tell us promptly about unauthorized access. You may not sell, transfer, automate, scrape, or misuse an account. You are responsible for activity performed through your account unless prohibited by law.

4. Safety

Use your judgment. Do not trespass, drive while using the app, approach dangerous wildlife, enter unsafe areas, or attempt activities beyond your ability. Adapt or skip any challenge. Fareld is not an emergency, navigation, medical, or safety service.

5. Your content

You keep ownership of photos and captions you submit. You grant Fareld a worldwide, nonexclusive, royalty-free license to host, copy, resize, moderate, display, and distribute that content only as needed to operate, secure, promote within, and improve the service. This license ends when the content is deleted, except for lawful backups, cached copies, moderation records, and content already shared outside our control.

6. Content rules

Only upload content you created or have permission to share. Do not submit illegal, sexual, exploitative, hateful, harassing, violent, deceptive, privacy-invasive, infringing, dangerous, or spam content. Do not expose addresses, license plates, private communications, or people who did not consent. Ratings must address how well a submission fits its challenge, not the person who posted it.

7. Moderation and enforcement

Automated systems and trusted reviewers may screen, restrict, reject, remove, preserve, or report content. Users can report submissions and block accounts. We may suspend or terminate accounts that create risk, violate these Terms, abuse reporting or ratings, or threaten the service. Moderation is imperfect and does not make Fareld responsible for user content.

8. Intellectual property

Fareld’s software, branding, challenge catalog, interface, and original materials belong to Randy Fust or his licensors. These Terms give you a personal, limited, revocable, nontransferable right to use the service. They do not transfer Fareld intellectual property to you.

9. Third-party services

Fareld relies on providers including Supabase for authentication, database, functions, and storage, and OpenAI for automated content moderation. Their availability and processing may affect the service. Their own terms and privacy practices also apply to their services.

10. Account deletion

You can permanently delete your account from Settings after confirming your password. Account deletion removes the account and associated photos, ratings, reports, and blocks from active systems, subject to limited security records, legal obligations, and backup retention. Deleting an individual photo does not erase achievement or completion history already earned.

11. Disclaimers

To the maximum extent permitted by law, Fareld is provided “as is” and “as available.” We do not guarantee uninterrupted access, moderation accuracy, challenge completion, community ratings, preservation of content, or any particular result. Nothing in these Terms excludes consumer guarantees or other rights that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Randy Fust is not liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, personal decisions, user conduct, or conditions encountered while completing a challenge. Any liability that cannot be excluded is limited only to the extent the law permits.

13. Changes and termination

We may update these Terms to reflect feature, legal, safety, or business changes. Material changes will be presented in the app or through the account email before they take effect when required. Continued use after the effective date means acceptance where permitted. You may stop using Fareld and delete your account at any time.

14. Law and disputes

Mandatory consumer protections and the laws of your place of residence continue to apply when they cannot be waived. Before filing a claim, please contact us so we can try to resolve it informally. Any governing-law or forum requirement will be applied only where legally valid.
